§1 Preliminary issues
These Regulations (hereinafter referred to as the "Regulations") define the general conditions for the sale of goods in the online store located on the www.timosimo.pl platform (hereinafter referred to as the "Store") offered by the economic entity (hereinafter referred to as the "Company"): TimoSimo Małgorzata Piotrowska, ul. Łozowa 35A 62-002 Suchy Las, NIP: 7811749557 REGON: 367827732.
In the further part of the Regulations, the person who purchases the goods in the Store is called the "Customer".
The purchase of goods offered in the Store may be made by natural persons of legal age with legal capacity.
Before placing an order, the Customer is obliged to read and accept these Regulations. Acceptance of the Regulations is a prerequisite to use the Store's services and takes place while completing the order form.
§2 Offer
1. The subject of the transaction are the products listed in the Store's offer at the time of ordering.
2. The prices of the products in the Store's offer are gross prices and are given in the Polish currency and euro.
3. The binding price is the price given in the Store for the given goods at the time of placing the order.
4. The store reserves the right to make changes to the prices of goods on offer, to introduce new goods to the offer, to conduct and cancel promotional campaigns, or to introduce changes to them.
5. Information on the goods offered by the Store does not constitute an offer within the meaning of the Civil Code, but is only a presentation of the products offered by the Store.
§3 Order
The condition for the implementation of purchases is the correct submission of the order on the website www.timosimo.pl
Orders can be placed in the following way: via the form available on the Store's website, or in the case of special orders, via the e-mail address available on the Store's website or by telephone at +48 607 269 639.
The condition for the order to be fulfilled is to provide data allowing verification of the customer and the recipient of the goods. The store confirms the acceptance of the order by e-mail. At the same time, the Store has the right to refuse to accept the order when the order raises justified doubts as to the truthfulness and reliability of the data provided.
The parties are bound by the information contained on the Store's website next to the purchased goods at the time of placing the order, in particular: price, product characteristics, its features, elements included in the set, date and method of delivery.
By placing an order, the customer makes an offer to purchase a specific product. The contract of sale is concluded when the Order is placed by the Customer by clicking the 'Confirm purchase' button. Additionally, an employee of the Store may contact the Customer to confirm the order by phone or email.
The store reserves the right to withdraw from the sale transaction if the goods are not available. The funds paid by the client will then be returned to the bank account indicated by the client.
In the event of any inaccuracies in the content of the e-mail confirming the acceptance of the order, the Store should be contacted immediately.
In the absence of payment for the goods covered by the order within 7 days from the date of placing the order by the Customer, the order will be canceled and the goods will be returned to sale, about which the Customer will be informed by sending an email to the address provided by the Customer.
§4 Payment
The customer can choose the payment methods specified in the 'Payment and delivery' tab: cash payment upon personal collection; payment by bank transfer to the Store's bank account; electronic payment via Przelewy24, payment with a voucher, payment via PayPal (available for foreign payments).
Shipment prices are specified in the "Payment and delivery" tab.
§5 Shipment
The ordered goods are sent by the Store via shipping companies (Poczta Polska, DPD), made available for collection by the customer at the Paczkomaty premises or a place indicated by the Store.
The purchased goods will be delivered to the address indicated by the Customer in the order form.
Orders are shipped within 24 hours on business days, unless a different date is specified in the product card. The beginning of the period of product shipment to the Customer, if the Customer chooses the method of payment by bank transfer, electronic payment or payment card, is counted from the date of crediting the bank account or the Store's settlement account.
The deadline for the product to be picked up by the customer, if the customer chooses cash on delivery, starts on the day of concluding the sales contract.
In the case of special orders, the delivery time is determined individually.
§6 Complaints
The store undertakes to deliver goods free from defects to the customer. In other words, the Store is liable for defects in the subject of the service corresponding to the contract, taking into account the provisions of the Civil Code in this regard.
After delivering the parcel to its destination, the customer should check that the parcel is not damaged. If he finds any defects, the Customer and the carrier should draw up a damage report.
If, after receiving the goods, the Customer finds physical defects in it or in the event of non-compliance with the contract, the Customer is entitled to make a complaint under the warranty.
The basis for accepting the complaint is the Customer's presentation of a proof of purchase of the goods in the Store (e.g. a bill, e-mail confirming the purchase, confirmation of a transfer or other document showing that the Customer has purchased the goods in the Store) together with a description of the defects and the damage report in the event that the shipment has been sent. damaged.
The complaint should contain the reason for submitting the complaint, it should define the scope of the Client's request and should be signed and contain the Client's current data.
Complaints should be submitted in electronic form to the email address contact@timosimo.pl or in writing to the address of the Company's seat.
The advertised goods must be delivered in person or sent to the address of the Company's registered office.
The seller is responsible for the defective goods 2 years from the date of its release, while the deadline for submitting a complaint is 1 year from the moment the defect was discovered.
The store will respond to the customer's requests within 14 days of receiving the complaint. If the Store does not accept the Customer's complaint, and the Customer does not agree with his decision, the Customer may request mediation or settlement to the Permanent Consumer Arbitration Court ("Arbitration Court") operating at the competent Provincial Inspectorate of Trade Inspection.
The customer who is a consumer also has the right to refer the matter to the Municipal or Poviat Consumer Ombudsman or may seek help from the relevant Consumer Federation.
In the event of defects, the buyer may exercise the rights under the warranty by specifying the following requests:
*) Repairs
*) Exchange of goods for a new one
*) Price reduction
*) Withdrawal from the contract (refund)
§7 The right to withdraw from the contract
Pursuant to the Act of May 30, 2014 on consumer rights, the Customer who is a consumer may withdraw from the contract without giving a reason and without incurring costs, except for the costs referred to below, within 14 days from the date of delivery of the goods.
The right to return does not apply in the case of goods manufactured according to the customer's specification - i.e. custom-made products, which are each time treated as a product made according to the customer's individual order and closely related to his person.
The consumer may withdraw from the contract by submitting a declaration of withdrawal from the contract to the address 62-002 Suchy Las, ul. Łozowa 35A or to the email address kontakt@timosimo.pl. The declaration may be submitted on the form attached hereto. Its use is not obligatory - the customer may submit a declaration of withdrawal from the contract in any form. If the Customer decides to submit the statement electronically, the Store will send the Customer a confirmation of receipt of the statement. Sending a declaration of withdrawal from the contract within 14 days of receipt of the goods is enough to meet the deadline.
The customer is obliged to return the goods to the Store within 14 days of submitting the declaration of withdrawal from the contract. Returned goods must be complete. Goods should be returned unchanged.
The store may refund the Customer the amount of the value of the goods reduced by the amount corresponding to the reduction in the value of the goods, which may be caused by poor handling of the goods in a way other than necessary to establish the characteristics, functionality and nature of the goods.
The store refunds the amount due for the returned goods (payments for the goods, including delivery costs) within 14 days of receiving the statement. If the consumer has chosen a delivery method other than the cheapest delivery method offered by the Store, the Store is not obliged to refund the additional costs incurred by the Customer.
The consumer bears the direct costs of returning the goods to the Store. Returned goods should be sent only to the company's address.
§8 Personal data protection

§9 Other issues
It is forbidden to use any materials published on the Store's website (including photos and descriptions of goods) without the Store's written consent.
The Regulations come into force on the day of publication on the Store's website.
The Store reserves the right to amend the Regulations, which shall enter into force on the day of their publication on the website www.timosimo.pl Agreements concluded before the amendment to the Regulations shall be governed by the version of the Regulations in force on the date of placing the order by the Customer.
